Poder judicial

The judiciary is a power of the State in charge of administering justice in society, through the application of legal rules in conflict resolution. By "Power", in the sense of public power, it means the organization, institution or set of State organs, which in the case of the Judicial Branch are the judicial or jurisdictional organs: courts and tribunals, exercising jurisdictional power, Which usually enjoy impartiality and autonomy. According to Montesquieu's classical theory of separation of powers, which distinguishes between legislative, executive and judicial power, the division guarantees freedom of the citizen. Montesquieu composed his theory after a trip to England where he interpreted that an independent judiciary can be an effective brake of the executive power. Under this separation of powers, the so-called rule of law is born, in which the public powers are equally subject to the rule of law. El poder judicial es un poder del Estado encargado de administrar la justicia en la sociedad,mediante la aplicación de las normas jurídicas en la resolución de conflictos. Por "Poder", en el sentido de poder público, se entiende a la organización, institución o conjunto de órganos del Estado, que en el caso del Poder Judicial son los órganos judiciales o jurisdiccionales: juzgados y tribunales, que ejercen la potestad jurisdiccional, que suele gozar de imparcialidad y autonomía. Según la teoría clásica de Montesquieu de la separación de poderes, que distingue entre poder legislativo, ejecutivo y judicial, la división garantiza la libertad del ciudadano. Montesquieu compuso su teoría después de un viaje a Inglaterra en donde interpretó que un poder judicial independiente puede ser un freno eficaz del poder ejecutivo. Bajo esta separación de poderes, nace el llamado estado de derecho, en el cual los poderes públicos están igualmente sometidos al imperio de la ley.
