Referendo

Referendum is an instrument of semi-direct democracy through which voters are called to pronounce by direct and secret suffrage on certain matters of relevant interest to the nation. It is usually used for exceptional decisions, whose response becomes binding. In Portugal today it can happen through a proposal of the Assembly of the Republic, or of the Government, to the President of the Republic that decides of its accomplishment. In Brazil, it depends on the issuance of a legislative decree by the Senate or the Chamber of Deputies, under the terms of Law 9,709 / 98, to be carried out. The difference between plebiscite and referendum in Latin law is that the plebiscite is called before the creation of the norm, and it is the people, through the vote, that will approve or not the question that is submitted to it. Already the referendum is called after the edition of the norm, and the people must ratify it or not. In Anglo-Saxon law, the terms "plebiscite" and "referendum" are used almost synonyms; its distinction is hazy. Referendo é um instrumento da democracia semidireta por meio do qual os cidadãos eleitores são chamados a pronunciar-se por sufrágio direto e secreto sobre determinados assuntos de relevante interesse à nação. Normalmente é utilizada quanto a decisões excepcionais, cuja resposta se torna vinculativa. Em Portugal hoje pode ocorrer mediante proposta da Assembleia da República, ou do Governo, ao Presidente da República que decide da sua realização. No Brasil, depende de expedição de decreto legislativo pelo Senado ou pela Câmara dos Deputados, nos termos da Lei 9.709/98, para que seja realizado. A diferença entre plebiscito e referendo no direito latino é que o plebiscito é convocado antes da criação da norma, e é o povo, por meio do voto, que vai aprovar ou não a questão que lhe for submetida. Já o referendo é convocado após a edição da norma, devendo o povo ratificá-la ou não. No direito anglossaxónico, os termos "plebiscite" e "referendum" são usados quase como sinónimos; sua distinção é enevoada.
