Arbitraje

El arbitraje, una forma alternativa de solución de controversias, es una técnica para la solución de controversias fuera de los tribunales. Las partes en una controversia lo remiten al arbitraje de una o más personas y acuerdan quedar obligados por la decisión arbitral. Un tercero revisa las pruebas en el caso e impone una decisión que es jurídicamente vinculante para ambas partes y aplicable en los tribunales. Otras formas de ADR incluyen la mediación y la resolución no vinculante de los expertos. El arbitraje se utiliza a menudo para la resolución de conflictos comerciales, particularmente en el contexto de las transacciones comerciales internacionales. En ciertos países, como los Estados Unidos, el arbitraje también se emplea frecuentemente en asuntos de consumo y empleo, donde el arbitraje puede ser obligatorio por los términos de empleo o contratos comerciales. El arbitraje puede ser voluntario o obligatorio y puede ser vinculante o no vinculante. El arbitraje no vinculante es similar a la mediación porque no se puede imponer una decisión a las partes.
