Acquittal

Dans la tradition de common law, un acquittement certifie officiellement que l'accusé est libre de l'accusation d'une infraction, en ce qui concerne le droit pénal. C'est ainsi même lorsque la poursuite est abandonnée nolle prosequi. La finalité d'un acquittement dépend de la compétence. Dans certains pays, comme les États-Unis, en vertu des règles de double danger et d'autrefois acquit, un acquittement permet d'empêcher le procès de l'accusé pour la même infraction, même s'il existe de nouveaux éléments de preuve qui impliquent davantage l'accusé. L'effet d'un acquittement dans les procédures pénales est le même, qu'il s'agisse d'un verdict du jury, ou s'il résulte de l'application d'une autre règle qui décharge l'accusé. Dans d'autres pays, l'autorité de poursuite peut interjeter appel d'un acquittement semblable à celui d'un accusé susceptible d'interjeter appel d'une déclaration de culpabilité. In the common law tradition, an acquittal formally certifies that the accused is free from the charge of an offense, as far as the criminal law is concerned. This is so even where the prosecution is abandoned nolle prosequi. The finality of an acquittal is dependent on the jurisdiction. In some countries, such as the United States, under the rules of double jeopardy and autrefois acquit, an acquittal operates to bar the retrial of the accused for the same offense, even if new evidence surfaces that further implicates the accused. The effect of an acquittal on criminal proceedings is the same whether it results from a jury verdict, or whether it results from the operation of some other rule that discharges the accused. In other countries, the prosecuting authority may appeal an acquittal similar to how a defendant may appeal a conviction.
