Opinion simultanée

En droit, une opinion concordante est une opinion écrite d'un ou plusieurs juges d'un tribunal qui est d'accord avec la décision prise par la majorité du tribunal, mais indique différentes raisons comme base de sa décision. Lorsqu'aucune majorité absolue du tribunal ne peut convenir sur la base de la décision de l'affaire, la décision du tribunal peut être contenue dans un certain nombre d'opinions concordantes et l'opinion concordante jointe par le plus grand nombre de juges est appelée la pluralité des opinions . En pratique, les opinions concordantes sont légèrement moins utiles aux avocats que les opinions de la majorité. Après avoir échoué à recevoir la majorité des voix de la cour, les opinions concordantes ne sont pas un précédent contraignant et ne peuvent être citées en tant que telles. Mais les opinions concordantes peuvent parfois être citées comme une forme de précédent persuasif. Le conflit de vues entre une opinion majoritaire et une opinion concordante peut aider un avocat à comprendre les points de droit articulés dans l'opinion majoritaire.
