L'examen direct ou l'examen en chef est une étape dans la procédure consistant à fournir des preuves des témoins dans une cour de justice. L'examen direct est l'interrogation d'un témoin par le parti qui l'a appelé, dans un procès. L'examen direct est habituellement effectué pour obtenir des preuves à l'appui de faits qui satisfont à un élément requis de la réclamation ou de la défense d'une partie. Dans l'examen direct, il est généralement interdit de poser d'importantes questions. Cela empêche un avocat d'alimenter les réponses à un témoin favorable. Une exception à cette règle se produit si un côté a appelé un témoin, mais il est compris, ou devient vite clair, que le témoin est hostile au côté de la controverse. L'avocat peut alors demander au tribunal de déclarer la personne qu'il a appelée au stand un témoin hostile. Si le tribunal le fait, l'avocat peut ensuite faire comparaître le témoin avec des questions principales lors d'un examen direct. The Direct Examination or Examination-in-Chief is one stage in the process of adducing evidence from witnesses in a court of law. Direct examination is the questioning of a witness by the party who called him or her, in a trial. Direct examination is usually performed to elicit evidence in support of facts which will satisfy a required element of a party's claim or defense. In direct examination, one is generally prohibited from asking leading questions. This prevents a lawyer from feeding answers to a favorable witness. An exception to this rule occurs if one side has called a witness, but it is either understood, or soon becomes plain, that the witness is hostile to the questioner's side of the controversy. The lawyer may then ask the court to declare the person he or she has called to the stand a hostile witness. If the court does so, the lawyer may thereafter ply the witness with leading questions during direct examination. The techniques of direct examination are taught in courses on Trial Advocacy. Each direct examination is integrated with the overall case strategy through either a theme and theory or, with more advanced strategies, a line of effort.
