Lawsuit

Un procès ou une «poursuite en justice» est une action civile intentée devant un tribunal où un demandeur, une partie qui prétend avoir subi une perte à la suite d'une action de défendeur, exige un recours légal ou équitable. Le défendeur est tenu de répondre à la plainte du demandeur. Si le demandeur réussit, le jugement est à la faveur du demandeur, et diverses ordonnances peuvent être émises pour faire respecter un droit, accorder des dommages-intérêts ou imposer une injonction temporaire ou permanente pour empêcher un acte ou forcer un acte. Un jugement déclaratoire peut être émis pour prévenir de futurs conflits juridiques. Un procès peut impliquer un règlement des différends des questions de droit privé entre particuliers, entités commerciales ou organismes à but non lucratif. Un procès peut également permettre à l'État d'être traité comme s'il s'agissait d'une partie privée dans un procès civil, en tant que demandeur ou défendeur en ce qui concerne une blessure, ou peut fournir à l'État une cause civile d'action pour faire respecter certaines lois. La conduite d'un procès est appelée litige. Les plaignants et les défendeurs sont appelés les justiciables et les avocats qui les représentent sont appelés plaideurs. The defendant is required to respond to the plaintiff's complaint. If the plaintiff is successful, judgment is in the plaintiff's favor, and a variety of court orders may be issued to enforce a right, award damages, or impose a temporary or permanent injunction to prevent an act or compel an act. A declaratory judgment may be issued to prevent future legal disputes. A lawsuit may involve dispute resolution of private law issues between individuals, business entities or non-profit organizations. A lawsuit may also enable the state to be treated as if it were a private party in a civil case, as plaintiff, or defendant regarding an injury, or may provide the state with a civil cause of action to enforce certain laws.
