Statele americane de faliment sunt instanțele create în temeiul articolului I al Constituției Statelor Unite. Ele funcționează ca unități ale instanțelor districtuale și au jurisdicție în materie de faliment. Sistemul actual al instanțelor de faliment a fost creat de Congresul Statelor Unite ale Americii în 1978, de la 1 aprilie 1984. Judecătorii falimentului în fiecare district judiciar în serviciu activ în mod regulat constituie o "unitate" a curții districtuale a Statelor Unite aplicabile (vezi 28 USC § 151 ). Judecătorul de faliment este numit pe o perioadă de 14 ani de către curtea de apel a Statelor Unite pentru circuitul în care se află districtul aplicabil (a se vedea 28 U.S.C § 152). United States bankruptcy courts are courts created under Article I of the United States Constitution. They function as units of the district courts and have subject-matter jurisdiction over bankruptcy cases. The federal district courts have original and exclusive jurisdiction over all cases arising under the bankruptcy code, (see 28 U.S.C. § 1334(a)), and bankruptcy cases cannot be filed in state court. Each of the 94 federal judicial districts handles bankruptcy matters. The current system of bankruptcy courts was created by United States Congress in 1978, effective April 1, 1984. The bankruptcy judges in each judicial district in regular active service constitute a "unit" of the applicable United States district court (see 28 U.S.C. § 151). The bankruptcy judge is appointed for a term of 14 years by the United States court of appeals for the circuit in which the applicable district is located (see 28 U.S.C. § 152). Technically, the United States district courts have subject matter jurisdiction over bankruptcy matters (see 28 U.S.C. § 1334(a)).
