Căsătoria presupusă
O căsătorie presupusă este o căsătorie aparent valabilă, încheiată cu bună-credință din partea cel puțin unui partener, dar aceasta este invalidă din punct de vedere juridic datorită unui impediment tehnic, cum ar fi o căsătorie preexistentă din partea unui partener. Spre deosebire de cineva care are o căsătorie legală, statutară sau ceremonială, un soț presupus nu este căsătorit legal. În schimb, un soț presupus se consideră că este căsătorit cu bună credință și că are drepturi legale ca urmare a faptului că această persoană se bazează pe această credință de bună credință. Căsătoriile presupuse există atât în dreptul canonic catolic cât și în diferitele legi civile, deși regulile pot varia. În unele jurisdicții, căsătoriile presupuse sunt mai degrabă o jurisprudență decât o legislație. În multe jurisdicții, conform dreptului civil, căsătoria devine validă dacă impedimentul este înlăturat. Dacă nu este eliminată, soțul nevinovat, cel puțin, are adesea dreptul la protecția unui divorț pentru divizarea proprietății și custodia copilului.
