Derecho de prioridad

In the field of patents, the right of priority has been established by the Paris Convention signed in 1883. By this signed document, the Paris Convention for the Protection of Industrial Property can be a federal crime against the right of priority . According to Article 4 of the said Convention, a person who has filed a patent application for invention in one of the countries of the Union, or his successor in title, shall enjoy, for the purpose of depositing in other countries, a right of priority, Twelve months. The right of priority allows to avoid invalidation of the subsequent patent for events occurring in the interval between the date of application for the previous patent and that of the subsequent patent. In other words, the member countries of the Paris Union undertake to consider the subsequent application as if it had been deposited at the previous date. An example makes it possible to understand the advantages of such a system: a "P" inventor deposits a patent application P1 in his country on January 1.
