Conciliation
La conciliation est un processus alternatif de règlement des différends par lequel les parties à un différend utilisent un conciliateur, qui rencontre séparément les parties afin de résoudre leurs différends. Ils le font en réduisant les tensions, en améliorant les communications, en interprétant les problèmes, en fournissant une assistance technique, en explorant des solutions potentielles et en établissant un règlement négocié. La conciliation diffère de l'arbitrage en ce sens que le processus de conciliation, en soi, n'a pas de statut juridique, et le conciliateur n'a généralement pas le pouvoir de rechercher des éléments de preuve ou d'appeler des témoins, n'écrit habituellement aucune décision et ne fait aucune sentence. La conciliation diffère de la médiation en ce sens que l'objectif principal est de concilier la plupart du temps en cherchant des concessions. En médiation, le médiateur essaie de guider la discussion d'une manière qui optimise les besoins des parties, prend en compte les sentiments et reforme les représentations. En conciliation, les parties se rencontrent rarement, si jamais, en face de la table en présence du conciliateur.
