La saisie est un processus juridique spécifique dans lequel un prêteur tente de récupérer le solde d'un prêt d'un emprunteur qui a cessé de faire des paiements au prêteur en forçant la vente de l'actif utilisé comme garantie pour le prêt. Formalement, un prêteur hypothécaire ou un autre détenteur de privilège obtient la résiliation du droit de rachat équitable de l'emprunteur hypothécaire, soit par voie d'ordonnance judiciaire, soit par application de la loi.
