Dans certains pays de common law, un engagement est une obligation conditionnelle qu'engage une personne devant un tribunal. Il s'agit d'une obligation d'enregistrement, conclue devant un tribunal ou un magistrat dûment autorisé, selon lequel le parti lié reconnaît qu'ils doivent une dette personnelle à l'État. Un engagement est sujet à une «défaite»; C'est-à-dire que l'obligation sera évitée si une personne liée exerce un acte particulier, comme l'apparition devant un tribunal d'un jour donné, ou la paix. Le concept de reconnaissance existe en Écosse, à Hong Kong, au Canada et aux États-Unis. Les personnes libérées par leur propre engagement sont susceptibles de comparaître devant un juge un certain jour dans un proche avenir. Les reconnaissances se rencontrent le plus souvent en matière de cautionnement dans les affaires criminelles. En déposant une caution avec le tribunal, le défendeur sera généralement libéré d'un emprisonnement en attendant un procès ou un appel. Si aucune caution n'a été fixée, les défendeurs sont libérés "à leur propre compte". La libération sur engagement est parfois abrégée comme RoR, ou, en particulier aux États-Unis, OR.

In some common law nations, a recognizance is a conditional obligation undertaken by a person before a court. It is an obligation of record, entered into before a court or magistrate duly authorized, whereby the party bound acknowledges that they owe a personal debt to the state. A recognizance is subject to a "defeasance"; that is, the obligation will be avoided if person bound does some particular act, such as appearing in court on a particular day, or keeping the peace. The concept of a recognizance exists in Scotland, Hong Kong, Canada and the United States. People who are released on their own recognizance are subject to appearing before a judge on a certain day in the near future. Recognizances are most often encountered regarding bail in criminal cases. By filing a bail bond with the court, the defendant will usually be released from imprisonment pending a trial or appeal. If no bail has been set, the defendants are released "on their own recognizance". Release on recognizance is sometimes abbreviated as RoR, or, particularly in the United States, OR.
