Spoliation de la preuve
La spoliation de la preuve est la retenue, la dissimulation, la modification ou la destruction intentionnelle ou négligente de preuves pertinentes à une procédure judiciaire. La spoliation a deux conséquences possibles: dans les juridictions où l'acte est criminel par la loi, il peut entraîner des amendes et l'incarcération pour les parties qui se sont engagées dans la spoliation; Dans les juridictions où un précédent jurisprudentiel pertinent a été établi, les procédures éventuellement modifiées par spoliation peuvent être interprétées dans le cadre d'une inférence de spoliation. L'inférence de la spoliation est une conclusion de preuve négative selon laquelle un chercheur de fait peut tirer de la destruction par un parti d'un document ou d'une chose qui est pertinente pour une procédure civile ou pénale en cours ou raisonnablement prévisible: le chercheur de fait peut examiner toutes les preuves révélées aussi fortes Une lumière possible contre le spoliator et en faveur de la partie adverse. La théorie de l'inférence de la spoliation est que lorsqu'une partie détruit les preuves, il est raisonnable de conclure que le parti a eu «conscience de culpabilité» ou autre motivation pour éviter les preuves. Par conséquent, l'enquêteur peut conclure que la preuve aurait été défavorable au spoliateur.
