Um pretexto é uma desculpa para fazer algo ou dizer algo que não é exato. Os pretextos podem ser baseados em uma meia verdade ou desenvolvidos no contexto de uma fabricação enganosa. Pretextos foram usados para esconder o verdadeiro propósito ou racionalidade de ações e palavras. Na lei dos EUA, um pretexto geralmente descreve falsos motivos que escondem as verdadeiras intenções ou motivações para uma ação legal. Se uma parte pode estabelecer uma prova prima facie para a evidência oferecida, a parte oposta deve comprovar que estas razões eram "pretextuais" ou falsas. Isso pode ser conseguido demonstrando diretamente que as motivações por trás da apresentação de evidências são falsas, ou indiretamente por evidências de que as motivações não são "credíveis". Em Griffith v. Schnitzer, um caso de discriminação de emprego, um julgamento do júri foi revertido por uma Corte de Apelação porque a evidência não era suficiente para que os motivos do arguido fossem "pretextuais". Ou seja, a evidência do arguido era indiscutível, ou o arguido era "avaliações e opiniões subjetivas irrelevantes".
