Na jurisprudência, uma desculpa ou justificação é uma defesa de acusações criminais que é distinta de uma exculpação. Assim, uma justificativa descreve a qualidade do ato, enquanto uma desculpa se refere ao status ou capacidade do acusado. Esses fatores podem afetar o julgamento resultante que pode ser uma absolvição, ou no caso de uma condenação pode mitigar a sentença.
