Na jurisprudência, uma desculpa ou justificação é uma defesa de acusações criminais que é distinta de uma exculpação. A exculpação é um conceito relacionado que reduz ou extingue a culpabilidade de uma pessoa e, portanto, a responsabilidade de uma pessoa em pagar uma indemnização à vítima de um delito na lei civil. A "desculpa" fornece um fator atenuante para um grupo de pessoas que compartilham uma característica comum. Justificação, como em homicídio justificável, justifica ou mostra a justiça. Assim, a sociedade aprova o propósito ou os motivos que sustentam algumas ações ou as conseqüências decorrentes delas, e distingue aqueles em que o comportamento não pode ser aprovado, mas pode ser encontrada alguma desculpa nas características do réu, por exemplo. que o acusado era um policial ou que sofria de uma doença mental. Assim, uma justificativa descreve a qualidade do ato, enquanto uma desculpa se refere ao status ou capacidade do acusado. Esses fatores podem afetar o julgamento resultante que pode ser uma absolvição, ou no caso de uma condenação pode mitigar a sentença.
