Ein Vertrag ist eine völkerrechtliche Vereinbarung von Akteuren des Völkerrechts, nämlich souveräne Staaten und internationale Organisationen. Ein Vertrag kann unter anderem auch als Vereinbarung, Protokoll, Bund, Konvention, Pakt oder Briefwechsel bezeichnet werden. Unabhängig von der Terminologie sind alle diese Vereinbarungen nach dem Völkerrecht gleichermaßen als Verträge und die Regeln gleich. Verträge können lose mit Verträgen verglichen werden: Beide sind Mittel der bereitwilligen Parteien, die Verpflichtungen untereinander übernehmen, und eine Partei, die entweder ihren Verpflichtungen nicht nachkommt, kann nach internationalem Recht haftbar gemacht werden.
