Dans le contexte de la guerre, la perfidie est une forme de déception dans laquelle un côté promet d'agir de bonne foi dans l'intention de rompre cette promesse une fois que l'ennemi s'est exposé. La perfidie constitue une violation des lois de la guerre et constitue donc un crime de guerre alors qu'elle dégrade les protections et les contraintes mutuelles développées dans l'intérêt de tous les partis, combattants et civils. Dans la pratique, les combattants ont du mal à respecter les personnes et les objets protégés si l'expérience leur permet de croire ou de soupçonner que leurs adversaires abusent d'une protection en vertu du droit international pour obtenir un avantage militaire. La perfidie est spécifiquement interdite en vertu du Protocole additionnel I de 1977 aux Conventions de Genève du 12 août 1949, qui stipule: Article 37. - Interdiction de la perfidie 1. Il est interdit de tuer, de blesser ou de capturer un adversaire en cas de perfidie. Les actes invitant la confiance d'un adversaire à l'inciter à croire qu'il a le droit ou l'obligation d'accorder une protection en vertu des règles de droit international applicables dans les conflits armés, dans l'intention de trahir cette confiance, constituent une perfidie.

In the context of war, perfidy is a form of deception in which one side promises to act in good faith with the intention of breaking that promise once the enemy has exposed themselves. Perfidy constitutes a breach of the laws of war and therefore making it a war crime as it degrades the protections and mutual restraints developed in the interest of all parties, combatants, and civilians. In practice, combatants find it difficult to respect protected persons and objects if experience causes them to believe or suspect that their adversaries are abusing claim to protection under international law to gain a military advantage. Perfidy is specifically prohibited under the 1977 Protocol I Additional to the Geneva Conventions of 12 August 1949, which states: Article 37. – Prohibition of perfidy 1. It is prohibited to kill, injure or capture an adversary by resort to perfidy. Acts inviting the confidence of an adversary to lead him to believe that he is entitled to, or is obliged to accord, protection under the rules of international law applicable in armed conflict, with intent to betray that confidence, shall constitute perfidy.
