Diffamation

La diffamation - également appelée calomnie, vilissement ou traduction - est la communication d'une fausse déclaration qui nuit à la réputation d'un individu, d'une entreprise, d'un produit, d'un groupe, d'un gouvernement, d'une religion ou d'une nation. La plupart des juridictions autorisent une action en justice pour dissuader diverses sortes de diffamation et réagir contre des critiques sans fondement. En vertu de la common law, pour constituer une diffamation, une réclamation doit généralement être fausse et avoir été faite à une personne autre que la diffamée. Certaines juridictions de common law distinguent également la diffamation parlé, appelée calomnie et diffamation dans d'autres médias tels que des mots ou des images imprimés, appelés diffamation. Les lois de fausses lois protègent contre les déclarations qui ne sont pas techniquement fausses mais trompeuses. Dans certaines juridictions de droit civil, la diffamation est considérée comme un crime plutôt que comme un faux fondamental. La Commission des droits de l'homme des Nations Unies a statué en 2012 que la criminalisation de la diffamation viole la liberté d'expression et est incompatible avec l'article 19 du Pacte international relatif aux droits civils et politiques. Une personne qui diffuse un autre peut être appelée "défamer", "famacide", "libeler" ou "calomniateur".
