Diffamazione

Defamation

La diffamazione - chiamata anche calunnia, furia o traduzioni - è la comunicazione di una falsa dichiarazione che danneggia la reputazione di un individuo, di un business, di un prodotto, di un gruppo, di un governo, di una religione o di una nazione. La maggior parte delle giurisdizioni consente all'azione legale di dissuadere varie forme di diffamazione e di opporsi a critiche ingiustificate. Secondo il diritto comune, per costituire la diffamazione, una richiesta deve essere generalmente falsa e essere stata fatta a qualcuno diverso dalla persona scaglionata. Alcune giurisdizioni di diritto comune distinguono anche la diffamazione parlata, chiamata calunnia, e la diffamazione in altri mezzi come le parole o le immagini stampate, chiamate frode. Le leggi leggere false proteggono da dichiarazioni che non sono tecnicamente false ma ingannevoli. In alcune giurisdizioni di diritto civile, la diffamazione viene considerata come un reato piuttosto che un errore civile. La commissione per i diritti dell'uomo delle Nazioni Unite ha stabilito nel 2012 che la criminalizzazione del ribrezzo viola la libertà di espressione e non è conforme all'articolo 19 del Patto internazionale sui diritti civili e politici. Defamation—also called calumny, vilification, or traducement—is the communication of a false statement that harms the reputation of an individual, business, product, group, government, religion, or nation. Most jurisdictions allow legal action to deter various kinds of defamation and retaliate against groundless criticism. Under common law, to constitute defamation, a claim must generally be false and have been made to someone other than the person defamed. Some common law jurisdictions also distinguish between spoken defamation, called slander, and defamation in other media such as printed words or images, called libel. False light laws protect against statements which are not technically false but misleading. In some civil law jurisdictions, defamation is treated as a crime rather than a civil wrong. The United Nations Commission on Human Rights ruled in 2012 that the criminalization of libel violates freedom of expression and is inconsistent with Article 19 of the International Covenant on Civil and Political Rights. A person who defames another may be called a "defamer", "famacide", "libeler" or "slanderer".
