Un prétexte est une excuse pour faire quelque chose ou dire quelque chose qui n'est pas précis. Les prétextes peuvent être basés sur une demi-vérité ou développés dans le contexte d'une fabrication trompeuse. Des prétextes ont été utilisés pour dissimuler le véritable but ou la raison d'être des actions et des mots. Dans la loi américaine, un prétexte décrit habituellement des fausses raisons qui cachent les véritables intentions ou motivations pour une action en justice. Si une partie peut établir une preuve prima facie pour la preuve proposée, la partie adverse doit prouver que ces raisons étaient "prétextuelles" ou fausses. Cela peut être accompli en démontrant directement que les motivations derrière la présentation de la preuve sont fausses, ou indirectement par la preuve que les motivations ne sont pas «crédibles». Dans Griffith v. Schnitzer, un cas de discrimination en matière d'emploi, un jugement du jury a été renversé par une Cour d'appel parce que les éléments de preuve n'étaient pas suffisants pour que les motifs du défendeur soient «prétextuels». C'est-à-dire que la preuve du défendeur était incontestée, ou le demandeur était «des évaluations et opinions subjectives non pertinentes».

A pretext is an excuse to do something or say something that is not accurate. Pretexts may be based on a half-truth or developed in the context of a misleading fabrication. Pretexts have been used to conceal the true purpose or rationale behind actions and words. In US law, a pretext usually describes false reasons that hide the true intentions or motivations for a legal action. If a party can establish a prima facie case for the proffered evidence, the opposing party must prove that the these reasons were "pretextual" or false. This can be accomplished by directly demonstrating that the motivations behind the presentation of evidence is false, or indirectly by evidence that the motivations are not "credible". In Griffith v. Schnitzer, an employment discrimination case, a jury award was reversed by a Court of Appeals because the evidence was not sufficient that the defendant's reasons were "pretextual". That is, the defendant's evidence was either undisputed, or the plaintiff's was "irrelevant subjective assessments and opinions".
