From Latin dērogāre to repeal some part of a law, modify it, from de- + rogāre to ask, propose a law.

Derogare
Derogarea este revocarea parțială a unei legi, spre deosebire de abrogarea sau abolirea totală a unei legi. Termenul este utilizat atât în dreptul civil, cât și în dreptul comun. Uneori se folosește, deseori, abrogarea, la fel ca în maximul juridic: Lex posterior derogat priori, adică o lege ulterioară impune abolirea unui precedent. Derogarea diferă de dispensă în sensul că se aplică legii, în care dispensațiile se aplică anumitor persoane afectate de lege. În ceea ce privește legislația Uniunii Europene, o derogare poate implica și faptul că un stat membru întârzie implementarea unui element al unui regulament UE în sistemul său juridic într-un anumit interval de timp, cum ar fi cinci ani; sau că un stat membru a optat să nu aplice o dispoziție specifică într-un tratat din cauza circumstanțelor interne.
