Em termos legais, um argumento é simplesmente uma resposta a uma reivindicação feita por alguém em um caso criminal de acordo com a lei comum usando o sistema contraditório. Coloquialmente, um argumento passou a significar a afirmação de um réu em uma ação judicial, ou de outra forma em resposta a uma acusação criminal, se essa pessoa se declarou culpada, não culpada, sem concurso ou argumento de Alford. O conceito do fundamento é uma das principais diferenças entre o procedimento penal de acordo com o direito comum e o procedimento no âmbito do sistema de direito civil. De acordo com o direito comum, um arguido de culpa pelo arguido renuncia ao julgamento das acusações e o réu pode ser condenado imediatamente. Isso produz um sistema conhecido sob a lei americana como negociação de súbditos. Nas jurisdições de direito civil, geralmente não há um conceito de culpa. A confissão do réu é tratada como qualquer outra evidência, e uma confissão completa não impede que um julgamento completo ocorra ou liberte o autor do dever de apresentar um caso ao tribunal de primeira instância. Um "argumento cego" é um argumento de culpa inscrito com nenhum acordo de convênio no lugar.
