Harm este un concept moral și juridic. Bernard Gert interpretează daunele ca oricare dintre următoarele: ▪ durere ▪ moarte ▪ invaliditate ▪ pierderea capacității sau a libertății ▪ pierderea plăcerii Joel Feinberg dă o imagine a daunelor ca împiedicări la interese. El distinge interesele de bunăstare de interesele ulterioare. Prin urmare, din punctul său de vedere există două tipuri de prejudicii. Preocupările de bunăstare sunt interese în continuarea pentru un interval previzibil al vieții, interesele în sănătatea și vigoarea fizică a fiecăruia, integritatea și funcționarea normală a trupului, absența durerii și suferinței absorbante sau a desfigurării grotești, acuitatea intelectuală minimală, stabilitatea emoțională, lipsa anxietăților și resentimentelor neîntemeiate, capacitatea de a se angaja în mod normal în relații sociale și de a se bucura și de a-și menține prietenii, cel puțin venit minim și siguranță financiară, un mediu social și fizic tolerabil, constrângere.
